Context: My mother and father got divorced around 4 years ago, it is a split custody arrangement where my brother stays with my mother during the school years, and stays with my father during breaks. Because I'm not a minor I don't know go with him and stay with my mother full time. Now recently my father filed for a custody switch, so he can have my brother during the school year and my mother will get him during breaks. Anyway, I have plan to CTB this month, however the court date is in October. If it's found that I kms while living with my mother do you think this shall affect her chances of keeping custody of my brother, even though I don't have to legally stay with her?

"A judge will not alter custody or remove the child from the parent simply because a tragic death occurs in the household. Family courts make all custody decisions strictly around the best interests of the minor child.

Unless there is direct evidence showing that the mother was negligent or created an actively dangerous environment, the court evaluates whether she can maintain a stable home and support the surviving child through grief."
